By accessing or using SusuMoney or any service provided through mensol.org, you agree to be bound by these Terms of Use. If you do not agree, do not use the platform.

These Terms govern your use of the SusuMoney platform and all services available through mensol.org and its subdomains, operated by MenSol LLC, a limited liability company organized under the laws of the State of Minnesota, United States.

1. About MenSol LLC & SusuMoney

MenSol LLC ("MenSol", "the Company") is the legal entity that owns, operates, and maintains the mensol.org platform and all associated subdomains. SusuMoney is the primary service and consumer-facing brand offered by MenSol LLC. All references to "SusuMoney", "the Platform", "we", "us", or "our" in these Terms refer to MenSol LLC and its SusuMoney service.

SusuMoney is a software-as-a-service platform that provides digital tools to help community groups organize, track, and manage rotating savings circles, commonly known as Sousou, Sol, Susu, Partner, Tanda, Hui, Chit Funds, or similar arrangements (collectively "ROSCA"). Group admins add members, track contributions, and manage payouts.

2. Not a Financial Institution

SusuMoney is not a bank, credit union, financial institution, money transmitter, payment processor, investment advisor, broker, lender, or insurance provider. We do not:

• Hold, receive, transfer, or safeguard any funds on behalf of users
• Guarantee any financial returns, payouts, or contributions
• Provide financial, legal, or tax advice
• Act as a fiduciary for any group or member
• Insure or protect funds against loss, theft, or fraud

All money movement occurs directly between members of your savings group. SusuMoney provides organizational software tools only.

3. User Eligibility

You must be at least 18 years of age to use SusuMoney. By using the platform, you represent and warrant that you are legally capable of entering into binding agreements and that all information you provide is accurate, complete, and current.

4. Administrator Responsibilities

Group administrators ("Admins") who create and manage savings circles on SusuMoney agree to:

• Act honestly and transparently toward all group members
• Obtain informed consent from each member before entering their personal information into the platform
• Accurately record all contributions, payments, and payouts
• Comply with all applicable local, state, federal, and international laws regarding money pooling, savings groups, and financial activities
• Not use SusuMoney to facilitate fraud, money laundering, tax evasion, or any illegal activity
• Promptly notify members of any changes to the group structure or payout schedule

SusuMoney bears no responsibility for the actions or omissions of any group administrator.

5. Member Risks & Acknowledgment

Rotating savings circles carry inherent financial risks. By participating through SusuMoney, all members acknowledge that:

• There is no guarantee that any member will receive their scheduled payout
• SusuMoney is not liable if a group member fails to contribute, disappears, or commits fraud
• Disputes between members are the responsibility of the members and administrator — SusuMoney provides no dispute resolution services
• Participation in any savings circle is entirely voluntary and at your own risk
• You should only participate with people you personally know and trust

6. Data Privacy & Security

We take the privacy and security of your data seriously. SusuMoney collects and stores member information including names, contact details, and payment records to provide the service. We commit to:

• Never selling your personal data to third parties
• Storing data on secure, encrypted servers
• Using industry-standard security practices including hashed PINs and encrypted connections (HTTPS)
• Limiting data access to authorized administrators of your specific group
• Honoring data deletion requests submitted to [email protected] within 30 days

Each savings group operates on its own isolated subdomain with completely separate data. Administrators of one group cannot access data from another group.

7. SMS Notifications & Messaging

When added to a group, members may receive a one-time SMS notification with their Member ID and login link. By being added to a group on mensol.org, you consent to receiving this notification.

• Message frequency is limited to account setup notifications (one-time only)
• To stop receiving SMS messages, reply STOP to any message

8. Acceptable Use Policy

You agree NOT to use SusuMoney for:

• Money laundering, fraud, or any criminal activity
• Pyramid schemes, Ponzi schemes, or gifting circles that are not genuine ROSCAs
• Tax evasion or financial misrepresentation
• Harassment, abuse, or threats toward other members
• Unauthorized access to other users' accounts or data
• Any activity that violates applicable law

Violation of this policy will result in immediate account termination without refund. We reserve the right to report suspected illegal activity to appropriate authorities.

9. Subscription & Payment Terms

• Free trial is limited to 30 days and up to 20 members — no credit card required
• Paid plans are billed in advance and are non-refundable except at our sole discretion
• We reserve the right to modify pricing with 30 days written notice to active subscribers
• Failure to pay will result in account suspension after a 7-day grace period
• Annual plans offer a discount equivalent to 2 months free compared to monthly billing

10. Intellectual Property

All content, design, code, logos, and materials on SusuMoney are the property of MenSol LLC (operating as SusuMoney) and are protected by copyright and intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our written permission. Your group data remains your property — you may export or request deletion at any time.

11. Limitation of Liability

To the maximum extent permitted by applicable law, MenSol LLC (operating as SusuMoney) and its officers, directors, employees, and agents shall not be liable for:

• Any financial loss, including unpaid contributions or missed payouts within your savings group
• Fraud or misconduct by group members or administrators
• Indirect, incidental, special, punitive, or consequential damages of any kind
• Loss of data, profits, goodwill, or business opportunities
• Service interruptions, outages, or technical failures

Our total aggregate liability to you shall not exceed the amount you paid to SusuMoney in the three (3) months preceding the claim. SusuMoney is not responsible for any financial disputes between savings group members. Group admins are responsible for managing their groups fairly and transparently.

12. Indemnification

You agree to indemnify, defend, and hold harmless MenSol LLC (operating as SusuMoney) and its affiliates, officers, directors, employees, agents, licensors, and suppliers from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney fees) arising from: (a) your use of the platform; (b) your violation of these Terms; (c) your violation of any third-party rights; (d) any dispute between members of your savings group; or (e) any content or data you submit to the platform.

13. Disclaimers

The platform is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the platform will be uninterrupted, error-free, or free of viruses or other harmful components. You assume all responsibility and risk for your use of the platform and your reliance on any information provided therein.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Minnesota, United States, without regard to conflict of law principles. Any dispute arising from these Terms or your use of SusuMoney shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration in Hennepin County, Minnesota, under the rules of the American Arbitration Association. You waive any right to participate in class action lawsuits against SusuMoney. Each party shall bear its own costs of arbitration unless the arbitrator determines otherwise.

15. Third-Party Services & Links

SusuMoney may contain links to or integrations with third-party websites, services, or applications (including but not limited to email providers, payment processors, and hosting services). SusuMoney does not control, endorse, or assume responsibility for any third-party content, privacy policies, or practices. Your interaction with any third-party service is solely between you and that third party. SusuMoney shall not be liable for any damage or loss caused by your use of or reliance on any third-party service.

16. Account Security

You are solely responsible for maintaining the confidentiality of your login credentials, including your member ID, PIN, or admin password. You agree to notify your group administrator immediately of any unauthorized use of your account. SusuMoney is not liable for any loss or damage arising from your failure to protect your account credentials. We implement security measures including account lockout after multiple failed login attempts, but no system is completely secure.

17. Service Availability & Modifications

SusuMoney reserves the right to modify, suspend, or discontinue the platform (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the service. We will make reasonable efforts to provide advance notice of planned maintenance or significant changes. Scheduled maintenance windows will be communicated to active subscribers when possible.

18. Force Majeure

SusuMoney shall not be liable for any failure or delay in performing its obligations under these Terms due to circumstances beyond its reasonable control, including but not limited to: acts of God, natural disasters, pandemics, epidemics, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, earthquakes, cyberattacks, power outages, internet service provider failures, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

19. No Waiver

The failure of SusuMoney to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by MenSol LLC (operating as SusuMoney).

20. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, and the remaining provisions of these Terms shall continue in full force and effect.

21. Assignment

You may not assign or transfer your rights or obligations under these Terms without the prior written consent of MenSol LLC (operating as SusuMoney). SusuMoney may assign its rights and obligations under these Terms without restriction, including in connection with a merger, acquisition, sale of assets, or by operation of law.

22. Entire Agreement

These Terms, together with any applicable subscription agreement or order form, constitute the entire agreement between you and MenSol LLC (operating as SusuMoney) regarding the use of the platform. These Terms supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the platform.

23. Modifications to Terms

SusuMoney reserves the right to modify these Terms at any time. We will notify active subscribers of material changes via email at least 14 days before they take effect. Your continued use of the platform after the effective date constitutes your acceptance of the revised Terms. If you do not agree to the changes, you must discontinue use and may request account deletion.

24. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, non-payment, or any activity we deem harmful to the platform or other users. Upon termination: (a) your right to use the platform ceases immediately; (b) you may request an export of your group data within 30 days before it is permanently deleted; (c) any fees owed to SusuMoney become immediately due; (d) provisions that by their nature should survive termination shall survive, including but not limited to Sections 11, 12, 13, 14, 18, 20, and 22.
